The CJFE is pleased that the that the The Attorney General has announced that it is not appealing the decision of Justice Morgan on the constitutional challenge to the system of access to tribunal hearing records. The CJFE intervened in the case in support of greater access to tribunal records and is delighted with the result. The CJFE’s counsel Julia Lefebvre of Bersenas Jacobsen said:
“Journalists serve a vital role in the functioning of Canadian democracy by reporting on all aspects of our justice system. Important legal cases are heard before administrative tribunals, not only the courts. This decision recognizes that unreasonable delays and unjustified limits on access to tribunal hearing documents will not be tolerated. We are pleased to see the constitutional right to freedom of expression respected and given practical meaning for those who report on human rights, housing, health and labour issues in Ontario.”
